ORDINANCE 1960-264I T ORDINANCE NO. 264 AN ORDINANCE REGULATING CANVASSING, SOLICI- TING AND DISTRIBUTING, FROM HOUSE TO HOUSE, WITHIN THE TOWNSHIP OF DELAWARE IN THE COUNTY OF CAMDEN AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF The Board of Commissioners of the Township of Delaware in the County of Camden, DO ORDAIN: Section 1. No person except as in this ordinance provided shall canvass, solicit or distribute circulars or other matter, from house to house, in the Township of Delaware without first having reported to and received a written permit from the officer in charge at Police Headquarters. Section 2. The officer in charge at Police Headquarters shall grant permits to canvass, solicit or distribute, upon applicant's compliance with the terms hereof, which permits shall bear an expiration date which shall be one year from date of issuance; such officer shall refuse to grant permits in all cases where the application or further investigation to be made at the discretion of such officer, shows that the applicant is not of good character, or that he is canvassing, soliciting or distribu- ting for a project not free from fraud. The officer in charge at Police Headquarters shall revoke the permit for failure or refusal on the part of the applicant to continuously comply with the rules and regulations herein set forth. Section 3. Before the permit may be issued: (a) the applicant shall make an application giving under oath his or her full name and address, age, height, weight, Place of birth, whether married or single, length and place of residence, whether or not previously arrested or convicted of a crime, by whom employed, address of employer and description of Project for which he or she is canvassing, soliciting or distribu- ting; (b) the applicant shall be fingerprinted and photo- graphed in the Delaware Township Police Headquarters. A copy Of the fingerprints and photograph shall be affixed to and be- come a part of any permit issued. (c) each applicant shall pay a fee of Ten Dollars ($10.00). Section 4. RULES AND REGULATIONS: No person shall canvass, solicit or distribute circulars, or other matter, from house to house in the Township of Delaware,, except between the hours of 9 A.M. and 5 P.M., Monday through Spturday. The permittee shall exhibit his or her permit to any police officer or other person upon request. The permittee shall be courteous to all persons in canvassing, soliciting or distributing and shall not importune or annoy any of the inhabitants of the Township and shall conduct himself or herself in a lawful manner. The fingerprints and photograph affixed to the permit shall not be removed, altered, obliterated or defaced. Section 5. (a) This ordinance shall not affect any person engaged in the delivery of goods, wares, or merchandise or other articles or things in the regular course of business to the premises of persons ordering or entitled to receive the same. ,, (b) This ordinance shall not affect any person: (i) who is acting on behalf of a bona fide religious, educational, charitable, fraternal, political or service organization or who is a resident of the Township of Delaware under the age of 18 years; and (ii) who has reported to the officer in charge at Police Headquarters prior to any can- vassing, soliciting or distributing circulars or other matter, from house to house, and has sup- plied the information required under Section 3(a) of this ordinance together with the name of the organization for which he or she is acting; and (iii) who has received and carries on his 1 or her person and exhibits on demand a non- transferable waiver of permit valid for two (2) months from date of issuance bearing his or her name, address and the organization for which he or she is acting, which waiver of permit shall be { '^ 80,5 _I issued by the officer in charge at Police Head- quarters, without fee, to each person who ful- fills the requirements of Section 5(b) (i) and 144 5(b) (ii) hereof. I- Section 6. Any person violating the provisions of this ordinance shall be subject to a fine not exceeding One Hundred Dollars ($100.00) or to imprisonment in the County Jail for a period not exceeding thirty days. In the event of the imposition of a fine and default in the payment thereof the defendant may be imprisoned in the County Jail for a term not exceeding thirty days. Section 7. Ordinance No. 131 entitled "Ordinance Regula- ting Canvassing Within the Township of Delaware, in the County of Camden and State of New Jersey, and Providing Penalties for the Violation Thereof" and the amendments and supplements thereto are hereby expressly repealed.
