ORDINANCE 1960-267812 ORDINANCE NO. 267 AN ORDINANCE AMENDING AND SUPPLEMENTING ORDINANCE NO. 256 KNOWN AS "THE DELAWARE TOWNSHIP ZONING ORDINANCE -OF 1960" The Board of Commissioners of the Township of Delaware in the County of Camden, DO ORDAIN: Section 1. That Ordinance No. 256 of the Township of Delaware known as "The Delaware Township Zoning Ordinance of 1960" be amended and the zoning map of the Township of Delaware be amended and corrected as hereinafter provided: Section 2. That a portion of Article III, "Schedule of Area, Yard and Building Requirements ", be and the same is hereby amended to read as follows: " Zone Minimum Front Yard Requirements R -A 35 feet R -1 35 feet" Section 3. That Section 504 be and the same is hereby amended to read as follows: "Section 504 No soil, mineral or similar material may be removed from any lot except that which is purely incidental to the construction of a building or structure. No excavation on any lot is permitted, exceeding one (1) foot in depth, un- less a building permit is first secured. In case of major subdivisions that have received prelimin- ary plat approval by the Planning Board, site grading, but not including excavations for construction purposes, may be initiated prior to obtaining a building permit." Section 4. That Section 512, paragraph 3, be and the same is hereby amended to read as follows: 3. Trailers. No portable house trailer shall be permitted on any lot except for a temporary' storage period which shall not exceed one (1) week in duration." Section 5. That Article V be and the same is hereby amended by adding Section 513 as follows: "Section 513 Fence construction, between the front property line and the required set back line in all residential zones, shall be restricted to a maximum height of three (3) feet above grade level." Section 6. That Section 1002, paragraph 7, be and the same is hereby amended to read as follows: . "7. Radio towers and antennas not exceeding one hundred (100) feet from grade in height pro- vided all other Township Ordinances are com- plied with." 813 Section 7. That Section 1102 be and the same is hereby amended by adding paragraph 6 to read as follows: 1 '6. Radio towers and antennas not exceeding one hundred (100) feet from grade in height pro- vided all other Township Ordinances are com- plied with." Section 8. That Section 1105, paragraph 1, be and the same is hereby amended to read as follows: "1. Shopping center - four (4) square feet of park- ing area for every square foot of gross floor area." Section 9. That Section 1105, paragraph 2, be and the same is hereby amended to read as follows: "2. Office building - three (3) square feet of parking area for every square foot of floor area of professional or business offices or " banks." Section 10. That Section 1202 be and the same is hereby amended by adding paragraph 4, to read as follows: "4. Radio towers and antennas not exceeding one hundred (100) feet from grade in height pro- vided all other Township Ordinances are com- plied with." s' Section 11. That Section 1301, paragraph 1 f, be and the ?j same is hereby amended to read as follows: 'rl 'ml f. Non- illuminated temporary signs on new con - construction sites not exceeding twelve (12) square feet in total area and provided they shall be removed within seven (7) days after I completion of the construction work. Illum- inated signs advertising major subdivisions 'II that have received preliminary plat approval d by the Planning Board shall not exceed two (2) in number, shall not exceed four hundred (400)i square feet in area each, and shall be removed* within ninety (90) days after completion of con- I struction work; said signs shall not be illum- inated between the hours of 10 p.m. and 7 a.m." Section 12. That Section 1304, paragraph 1, be and the same j is hereby amended to read as follows: "1. All signs that either exceed six (6) square feet in area or exceed fifty dollars ($50.) in value, shall require a building permit." Section 13. That Section 1304 be and the same is hereby amended by adding paragraph 7 to read as follows: 'I "7. No sign shall be illuminated between the '! hours of 10 p.m. and 7 a.m. the following morning, unless the business or use so advertised is open to the public later than 10 p.m., in which event any such es- tablishment may keep said sign illuminated until said business is closed to the public, but not thereafter." 3 814 Section 14. That Section 1305 be and the same is hereby amended by adding paragraph 9 to read as follows: 1 '9. Any sign exceeding seventeen (17) feet in.. height or located more than seventeen (17) feet above grade level." Section 15. That Section 1403 be and the same is hereby amended to read as follows: "Section 1403 Lots on which gasoline filling stations, public and commercial garages are located shall not be used for the sale of new or used vehicles and said lots shall at all times be kept free of paper and rubbish. No vehicle, or any type of salvage or maintenance material is to be stored outside of any principal or accessor building." Section 16. That Section 1601, paragraph 2 d, be and the same is hereby amended to read as follows: "d. School a nd Play round "(1) A school site of at least ten (10) acres shall be provided within the planned community if required by the Planning Board. 11 (2) A playground, pool or recreational site or sites shall be provided in the ratio of one I acre for every fifty (50) dwelling units in j� the planned community and no such site I shall be less than one (1) acre in area." I . Section 17. That Appendix A, Definitions, be and the same is hereby amended so that the definition of Buffer Strip shall read as follows: . "Buffer Stri . A five (5) foot wide strip of trees and or shrubs, at least five (5) feet in height, densely planted so as to restrict a clear view beyond said strip. Section 18. That the area zoned Neighborhood Business (B -1) on the South side of Maple Avenue East of Oakview Avenue be and the same is hereby extended Eastwardly to Bala Road a distance of fifty (50) feet for a depth of one hundred (100) feet along Maple Avenue. Section 19. That the section zoned for Highway Business (B -2) in the area bounded by Park Boulevard, Hampton Road, a line Parallel to and 343 feet southeast of Hampton Road, and a line Parallel to and 125 feet southwest of Marlton Pike be and is hereby changed to Residential R -2. 815 Section 20. That the section zoned for Residential R -2 in the area bounded by Park Boulevard, Hampton Road, a line parallel to and 343 feet northeast of Hampton Road, and a line 125 feet southwest of Marlton Pike be and is hereby changed to Highway Business (B -2) . Section 21. All ordinances or parts of ordinances incon- sistent with this amending ordinance be and they are hereby repealed to the extent of such inconsistencies only. i Section 22.
