ORDINANCE 1967-20/s;. Ordinance 67 -20 BOND ORDINANCE APPROPRIATING $640,000 AND AUTHORIZING THE ISSUANCE OF $640,000 BOND ANTICIPATION NOTES OF THE TOWNSHIP FOR ACQUISITION OF A SANITARY SEWER AGE SYSTEM BY THE TOWNSHIP OF CHERRY HILL, IN THE COUNTY OF CAMDEN, NEW JERSEY, AND PROVIDING FOR TEM- PORARY FINANCING OF SUCH APPROPRIATION IN ANTI- CIPATION OF THE SUBSEQUENT AUTHORIZATION OF PERMANENT BONDS CONTAINING SPECIAL COVENANTS AS AUTHORIZED BY NJS 40A: 2 -15. BE IT ORDAINED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF CHERRY HILL, IN THE COUNTY OF CAMDEN, NEW JERSEY, ( not less than two - thirds of all the members thereof affirmatively concurring), AS FOLLOWS: Section 1. The improvement described in Section 3 of this bond ordinance is hereby authorized as a general improvement to be made or acquired by The Township of Cherry Hill, in the County of Camden, New Jersey. For the said improvement or purpose stated in said Section 3, there is hereby appropriated the sum of $640,000, said sum being inclusive of all appropriations heretofore made therefor. Section 2. For the financing of said improvement or purpose and to meet said $640,000 appropriation and in anticipation of the issuance of negotiable bonds of the Township pursuant to the Local Bond Law of New Jersey and to temporarily finance said improvement or purpose, negotiable notes of the Township in a principal amount not exceeding $640,000 are hereby authorized to be issued pursuant to and within the limitations prescribed by said Law. Section 3. (a) The improvement hereby authorized and the purpose for the financing of which said obligations are to be issued is the acquisition by purchase or condemnation of all of the real and personal property ( other than cash and accounts receivable) IJ - 3 constituting the sanitary sewerage collection, treatment and dis- posal system or facilities or interests therein of the Marlton Township Sewerage Corporation, a corporation organized and doing business under the laws of the State of New Jersey, and designed or used for or in connection with the supplying of sanitary sewerage service in various areas of or locations in the Township, and as presently existing or as may be hereafter extended or enlarged pur- suant to existing agreements between said corporation and other persons, firms, or corporations, and consisting of sewage treatment plant, pumping stations, force mains, sanitary sewers, mains, later- als and connections, and all appurtenances therefor or thereto, equipment, supplies, buildings, structures and facilities and all real, personal property, easements, rights -of -way, personal or other property, rights of entry or egress necessary, useful or convenient for the aforesaid and including (A) the plot of land located on the Southeasterly side of Thornhill Road, together with existing sew- age treatment plant and other facilities, improvements and appurte- nances thereon, being more fully described as BEGINNING at a point the following five courses from a point common corner to lands of John White, St. Mary's Catholic Home and land now or formerly of Shivers and Haines, said common corner also being 820 feet, more or less, Northwestwardly from the center line of Cropwell Road at an angle point in Cropwell Road; then North 48 degrees 41 minutes 41 seconds West, 125.40 feet, then North 21 degrees 41 minutes 41 seconds West, 122.10 feet, then North 7 degrees 3 minutes 19 seconds East, 132 feet; then North 19 degrees 41 minutes 41 seconds West, 209.22 feet, then North 11 degrees 11 minutes 41 seconds West, 165 feet to the point of beginning and also being common corner to land of St. Mary's Catholic Home and land now or formerly of Shivers and Haines; Osler, Township Engineer, and on file in the office of the Township Clerk and hereby approved. (b) the estimated maximum amount of bonds or notes to be issued for said purpose is $640,000. (c) The estimated cost of said purpose is $640,000. /7a � f j. Section 4. The following matters are hereby determined, e1, declared, recited and stated: (a) The said purpose described in Section 3 of this bond ordinance is not a current expense and is a property or improvement which the Township may lawfully acquire or make as a general improve- ment, and no part of the cost thereof has been or shall be specially assessed on property specially benefited thereby. (b) The period of usefulness of said purpose, within the limitations of said Local Bond Law and according to the reasonable life thereof, is forty (40) years. (c) The supplemental debt statement required by said Law has been duly made and filed in the office of the Township Clerk and a complete executed duplicate thereof has been filed in the office of the Director of the division of Local Finance in the Department of Community Affairs of the State of New Jersey, and such statement shows that, while the net debt of the Township determined as pro- vided in said Law is not increased by this bond ordinance, the gross debt of the Township as defined in said Law is increased by this bond ordinance by $640,000, and the issuance of the said obli- gations authorized by this bond ordinance is permitted by the ex- ception contained in subsection (h) of section 40A :2 -7 of said Law to the debt limitations prescribed by said Law. (d) The aggregate amount of not exceeding $35,000 for �I items of expense permitted under section 40A :2 -20 of said Law has been included in the foregoing estimated cost of said improvement or purpose. (e) This bond ordinance authorizes obligations of the Township solely for a purpose described in subsection (h) of section 40A•2 -27 of said Law, and the said obligations authorized aI IIII by this bond ordinance are to be issued for a purpose which is "Self- liquidating" within the meaning and limitations of section 40A :2 -45 of said Law and are deductible, pursuant to subsection (c) of section 40A :2 -44 of said Law, from the gross debt of the Township stated in any annual or supplemental debt statement of the Township. Section 5. The full faith and credit of the Township are hereby pledged to the punctual payment of the principal of and in- terest on the said obligations authorized by this bond ordinance. Said obligations shall be direct, unlimited obligations of the Township, and, unless paid from revenues of the sanitary sewerage system of the Township, the Township shall be obligated to levy ad valorem taxes upon all the taxable property within the Township for the payment of said obligations and interest thereon without limitation of rate or amount. Section 6. Any ordinance of the Township hereafter adopted and authorizing the issuance of bonds of the Township for the permanent financing of the improvement or purpose authorized by this bond ordinance or for the funding or payment of theobligations au- thorized by this bond ordinance, shall contain and provide for covenants with the holders of such bonds as to use and disposition of the revenues to be derived from the operation of the sanitary sewerage system of the Township as a municipal public utility and as permitted or provided for by section 40A :2 -15 of said Local Bond Law. Section 7. This bond ordinance shall take effect twenty (20) days after the first publication thereof after final passage as provided by said Local Bond Law. /9z Introduc Adopted: Attest: Township Clerk
