ORDINANCE 1998-24ORDINANCE 98- 24 ORDINANCE AUTHORIZING THE ACQUISITION OF SANITARY SEWER EASEMENT RIGHTS ON A PORTION OF PROPERTY KNOWN AS BLOCK 404.12, LOT 25 (COMMONLY KNOWN AS 146 PEARLCROFT ROAD) AND ON A PORTION OF PROPERTY KNOWN AS BLOCK 404.12, LOT 26 (COMMONLY KNOWN AS 148 PEARLCROFT ROAD) FOR THE PURPOSE OF COMPLETING THE HUNT TRACT SANITARY SEWER EXTENSION WHEREAS, New Jersey Statutes authorize a municipality to acquire real property and easement rights by eminent domain pursuant to N.J.S.A. 20 :3 -1 et. seq. and N.J.S.A. 40:14B -34; and WHEREAS, the Township of Cherry Hill is undertaking a sanitary sewer construction project for the Hunt Tract Sewer Extension Project; and WHEREAS, there exists a property known as Block 404.12, Lot 25, and commonly known as 146 Pearlcroft Road; and WHEREAS, contiguous to the above property, there exists a property known as Block 404.12, Lot 26 and commonly known as 148 Pearlcroft Road; and WHEREAS, the Hunt Tract Sewer Extension project design necessitates a twenty (20) foot wide (ten feet on each property) sanitary sewer easement; and WHEREAS, the Township of Cherry Hill needs to acquire the sanitary sewer easement rights by eminent domain, 1,250 square feet of Block 404.12, Lot 25 (146 Pearlcroft Road) and 1,250 square feet of Block 404.12, Lot 26 (148 Pearlcroft Road); and WHEREAS, the Township of Cherry Hill has undertaken an appraisal which has the portion of the property needed for the project appraised at $1,800.00 [existing storm drainage easement - Block 404.12, Lot 25] and $4,600.00 [Block 404.12, Lot 26]; and WHEREAS, the Township of Cherry Hill has been unsuccessful in negotiating the price of the easement rights with the owners of the properties. NOW THEREFORE, BE IT ORDAINED by the Township Council of the Township of Cherry Hill, County of Camden and State of New Jersey that the Township of Cherry Hill acquire by eminent domain sanitary sewer easement rights in certain real property as described on the Schoor DePalma Engineering reports which are attached and are made a part of this Ordinance as if contained fully within. BE IT FURTHER ORDAINED that the proper Township officials be authorized to proceed in eminent domain against said portion of said property as allowed by law. This Ordinance shall take effect immediately upon the due passage and publication according to law.
