ORDINANCE 1998-25ORDINANCE 98- 25 ORDINANCE AUTHORIZING THE ACQUISITION OF TITLE IN FEE SIMPLE OF A PORTION OF PROPERTY KNOWN AS BLOCK 285.23, LOT 4 (COMMONLY KNOWN AS HAMPSHIRE HOUSE APARTMENTS, 606 COOPER LANDING ROAD) FOR THE PURPOSE OF WIDENING AND IMPROVING CHAPEL/ COOPER LANDING ROAD INTERSECTION WHEREAS, New Jersey Statutes authorize a municipality to acquire real property by eminent domain pursuant to N.J.S.A. 20:3 -1 et. seq. and N.J. S.A. 40:14B -34; and WHEREAS, the County of Camden is undertaking a construction project for the improvement and widening of the Cooper Landing Road and Chapel Avenue intersection; and WHEREAS, there exists a property known as Block 285.33, Lot 4, and commonly known as the Hampshire House Apartments, 606 Cooper Landing Road; and WHEREAS, the Township of Cherry Hill needs to acquire by eminent domain, 2,325 square feet of the above property; and WHEREAS, the Township of Cherry Hill has undertaken an appraisal which has the portion of the property needed for the project appraised at $8,500.00; and WHEREAS, the Township of Cherry Hill has been unsuccessful in negotiating the price of the property with the owner. NOW THEREFORE, BE IT ORDAINED by the Township Council of the Township of Cherry Hill, County of Camden and State of New Jersey that the Township of Cherry Hill acquire by eminent domain fee simple interest in certain real property as described on the Remington and Vernick Engineering report which is attached and is made a part of this Ordinance as if contained fully within. BE IT FURTHER ORDAINED that the proper Township officials be authorized to proceed in eminent domain against said portion of said property as allowed by law.
