ORDINANCE 2005-09ORDINANCE 2005 -9 • - AN ORDINANCE OF THE TOWNSHIP OF CHERRY HILL ADOPTING A REDEVELOPMENT PLAN BLOCK(S) 65.01; 595.03 LOT(S) 1, 2,3,4,5,6; 1 WHEREAS, the Township Council of the Township of Cherry Hill, County of Camden, State of New Jersey, finds that the public health safety and general welfare of the community shall be promoted by the virtue of a well planned redevelopment; and WHEREAS, the Township Council has reviewed the document entitled, "Redevelopment Area No. 4 (Route 70 Western Gateway Phase I): Preliminary Investigation and Redevelopment Plan" consistent with the New Jersey Local Redevelopment and Housing Law — N.J.S.A. 40A: 12A, 4 through 7, prepared by The Alaimo Group with assistance from the Planning Board staff, referred to the Planning Board for review and the for preliminary investigation to determine whether the proposed land is a redevelopment area; and WHEREAS, the planning Board in accordance with N.J.S.A. 40A:12A -6 has conducted a hearing on December 6, 2004 to solicit testimony from all persons affected by the redevelopment area having had an opportunity to be heard and no written objections to the plan have been filed; and WHEREAS, the Planning Board of the Township of Cherry Hill has adopted a Master Plan in • March of 2003 for the appropriate use and development of lands in the Township in a manner which will promote the public health, safety, morals and general welfare and has determined that the Redevelopment Plan is consistent with said Master Plan; and WHEREAS, the Planning Board shall submit a resolution to be made part hereof, that the Redevelopment Area No. 4 (Route 70 Western Gateway Phase I) Plan be adopted as stated and the area be so delineated as proposed; and WHEREAS, the Township Council does hereby make the following findings for adoption of the Redevelopment Plan pursuant to N.J.S.A. 40A: 12A-7: A. The area in need of redevelopment is delineated as BLOCK(S) 65.01; 595.03 and LOT(S) 1, 2, 3, 4, 5, 6; 1 B. The objectives of the Redevelopment Plan are consistent with the goals for development and redevelopment in the Master Plan. C. There will be no relocation of residents necessary to implement the Redevelopment Plan. BE IT ORDAINED by the Township Council of the Township of Cherry Hill, as follows: SECTION 1. Findings. The Township Council of the Township of Cherry Hill, by • Resolution 2003 -10 -9 dated October 14, 2003, authorized the Cherry Hill Township Planning Board to undertake a preliminary investigation to make a determination regarding a • Redevelopment Area, pursuant to N.J.S.A. 40A:12A -1 et. seq. The Cherry Hill Township Planning Board made available a map and initial investigation prepared by The Alaimo Group with assistance of the Planning Board staff and consisting of those properties generally known as the "Redevelopment Area 4: Route 70 Western Gateway Phase I site" (Block(s) 65.01; 595.03 Lot(s) 1, 2, 3, 4, 5, 6; 1) as the area proposed for redevelopment, and, following a Public Hearing on December 6, 2004 by Resolution recommended to the Township Council that the area be designated as a redevelopment area in accordance with the New Jersey Local Redevelopment and Housing Law, N.J.S.A. 40A: 12A-1 et. seq. SECTION 2. Adoption of Redevelopment Plan. There is hereby adopted, pursuant to the New Jersey Local Redevelopment and Housing Law, N.J.S.A. 40Al2A -7 et. seq., a Redevelopment Plan entitled "Township of Cherry Hill, Camden County, New Jersey, Redevelopment Plan", dated December 6, 2004 and prepared in cooperation by The Alaimo Group, the Department of Community Development, and the Township Council of the Township of Cherry Hill. Three copies of the Redevelopment Plan are,,on file with the Township Clerk of the Township of Cherry Hill and a copy of the Redevelopment Plan is available for public review . in the Cherry Hill Free Library. SECTION 3. Inconsistency. All ordinances and provisions thereof inconsistent with the provisions of this shall be and are hereby repealed to the extent of such consistency. SECTION 4. Severability. If any section, subsection or part of this ordinance shall be • declared invalid by judgment of any Court of Competent jurisdiction, such section, subsection, part, clause or phrase shall be deemed severable from the remainder of the ordinance.
