ORDINANCE 2017-04 ORDINANCE 2017-4 ORDINANCE AMENDING ORDINANCE 95-36 ENTITLED "REVISED GENERAL ORDINANCE,TOWNSHIP OF CHERRY HILL" CHAPTER X,TRAFFIC REGULATIONS SECTION 10-38 PARKING SUBSECTION 10-38.3 REGULATION FOR THE MOVEMENT AND THE PARKING OF TRAFFIC ON ALL OTHER PRIVATE PROPERTY WHEREAS, the Township of Cherry Hill is committed to preserving public safety and welfare, which includes protecting the safe travel of its citizens and the general public on streets and roads within the township including those located on private and semi-public properties; and WHEREAS, as part of this commitment, Cherry Hill Police Department's Traffic Squad regularly reviews site plans forwarded to them by the Cherry Hill Department of Community Development for potential traffic impacts and safety conflicts including the applicability of Subtitle 1 of Title 39 of the New Jersey Statutes onto certain private properties as requested by the properly applicant or as deemed appropriate by the Police Department; and WHEREAS, the Cherry Hill Police Department's Traffic Squad has determined that Subtitle 1 of Title 39 of the New Jersey Statutes should be made a condition of final site plan approval for the Penn Medicine complex constructed at 1865 Route 70 East in the Township of Cherry Hill given the locations and geometry of the semi- public roads and driveways; and WHEREAS, the applicant has completed the Private Property Title 39 process established through the Department of Community Development including having a licensed Professional Engineer design a Title 39 Compliance Plan for the property;and WHEREAS, the Police Traffic Safety Unit has reviewed the submitted Title 39 Compliance Plan and the site preparation and has determined that suitable traffic and parking controls have been designed and planned for implementation and there is a legal basis establishing their placement. NOW THEREFORE BE IT ORDAINED, by the Township Council of the Township of Cherry Hill, County of Camden, State of New Jersey, that Penn Medicine has filed written consent with the Township of Cherry Hill municipal officials that the provisions of Subtitle One of Title 39 of the revised statutes of New Jersey for Various Traffic Regulations be made applicable to the semi-public roads, streets, driveways and parking lots at the Medical Office Building (aka Penn Medicine) located in the TOWNSHIP OF CHERRY HILL, COUNTY OF CAMDEN; and the following regulations shall be enforceable based on the Title 39 Compliance Plan for "Proposed Medical Office Building" bearing a date of December 21, 2016 and a Title 39 certification date of January 10, 2017; Ordinance 95-36 entitled "Revised General Ordinances, Township of Cherry Hill," Section 10-38.3 is hereby amended as follows: SECTION I: 10-38.3 Regulation for the Movement and the Parking of Traffic on All Other Private Property n.. 1865 Route 70 East, aka Penn Medicine (added) 1. Applicability. The provisions of Subtitle 1 of Title 39 of the Revised Statutes of New Jersey are made applicable to the semi-public roads, streets, driveways and parking lots of the Bedford Plaza complex located at 606 Haddonfield Road in the Township of Cherry Hill, County of Camden, and the following regulations shall be enforceable: 2. General Parking: A. All vehicles must park in designated areas and between the lines provided. B. No person shall park a vehicle for longer than the time limit upon any of the streets or parts of streets described below. Handicapped Parking: All van accessible stalls shall be 11-feet wide, with a 5-foot loading area (or 8- feet wide, with an 8-foot loading area) and standard handicapped parking stalls shall be 8-feet wide with a 5-foot loading area as shown on the attached site plan and signed with R7-8 and R7-8P (Resented-Parking with Penalty Plate), in the designated parking areas for persons who have been issued the Handicapped Parking Permit by the Division of Motor Vehicles. 3. Through Streets, Stop and Yield Intersections: A. Through Streets: No 'through' traffic is permitted on the site for any other purpose than to utilize or patronize any facilities on the site. No person shall drive a motor vehicle through the property for the purpose of avoiding a traffic signal or sign on the public roadways. B. Stop Intersections: Stop intersections have been designated with Stop Signs as indicated on the Title 39 plan. 4. No Parkina/Stopping/Standina: A. No Parking, Stopping or Standing is permitted at any time along the site's main drive aisle between Marlkress Road (Cardone Ave driveway) and the Route 70 access point and has been designated with signage as indicated on the Title 39 plan. B. Any vehicle parked or standing as to obstruct or impede a normal flow of traffic, block entrances or exit ways, loading/unloading zones,pedestrian walkways, or present in any way a safely or traffic hazard maybe removed by towing the vehicle at the owners or operator's expense. 5. Unless another penally is expressly provided by New Jersey Statute, every person convicted of a violation of a provision of this Ordinance or any supplement thereto shall be liable for a penalty of not more than fifty ($50.00) dollars or imprisonment for a term not to exceed fifteen (15) days, or both. b. The effectiveness of this subsection is contingent on signs being erected as required by law. SECTION II: Any ordinance or parts of ordinance inconsistent with this amending ordinance are hereby repealed to the extent of such inconsistencies.
