ORDINANCE 2017-21 ORDINANCE 2017-21 ORDINANCE AMENDING ORDINANCE 95-36 ENTITLED "REVISED GENERAL ORDINANCES TOWNSHIP OF CHERRY HILL" CHAPTER 2 ADMINISTRATION WHEREAS, the Office of the Mayor is established under Ordinance 95-36, Chapter 2, Article III;and WHEREAS, Department of Community Development is established under Ordinance 95-36, Chapter 2, Article XIV; and WHEREAS, pursuant to Ordinance 2012-6 the Department of Community Development was restructured such that the Department of Construction Code Enforcement was made a Division of the Department of Community Development; and WHEREAS, it has been determined that the Department of Construction Code Enforcement should be restored to being a Department and it is not operationally beneficial to the Township for the Department of Construction Code Enforcement to be a Division within the Department of Community Development; and WHEREAS, it has been determined that the Administrative Organization should be updated and amended to establish the position of Chief of Staff as a Department Head within the Office of the Mayor; and NOW,THEREFORE, BE IT ORDAINED by the Township Council of the Township of Cherry Hill, County of Camden, State of New Jersey that Ordinance 95-36 entitled "Revised General Ordinance, Township of Cherry Hill," Chapter 2, Article III (The Mayor) be amended as follows: 2-3.7 Chief of Staff; Appointment; Term. There is hereby created within the Office of the Mayor the position of Chief of Staff, who shall be appointed by the Mayor, with the advice and consent of Council, for the term of the Mayor appointing him/her and until appointment and qualification of a successor, and to be paid such compensation as shall be fixed from time to time by a general salary ordinance, and who shall be the appointing authority for all personnel and necessary to carry out the duties and functions of the Chief of Staff. 2-3.8 Duties and Functions of Chief of Staff The Chief of Staff shall be a Department Head and shall oversee the administrative staff of the Office of the Mayor. Responsibilities shall include: assisting the Mayor in evaluating plans, policies, objectives and guidance by performing research and review of materials, and assembly of factual information; collaborates with all stakeholders to ensure effective implementation of major initiatives; provides oversight and counsel on matters of communication strategy, social media and messaging to Mayor and Council; oversees constituent relations; coordinates with Business Administrator to prepare Mayor and Council for Council meetings; advise on local policy and legislative matters; maintains strategic community partnerships; represents Mayor and Council at meetings and advisory boards; attends meetings for elected officials as requested. BE IT FURTHER ORDAINED by the Township Council of the Township of Cherry Hill, County of Camden,State of New Jersey that Ordinance 2012-6 shall be repealed; and BE IT FURTHER ORDAINED Ordinance 95-36 entitled "Revised General Ordinance,Township of Cherry Hill," Chapter 2, Article XIV (Department of Community Development) and Article XV (Division of Construction Code Enforcement) be amended as follows: ARTICLE XIV DEPARTMENT OF COMMUNITY DEVELOPMENT (amended to read) 2-32 DEPARTMENT OF COMMUNITY DEVELOPMENT ESTABLISHED. (amended to read) 2-32.1 Creation; Divisions. There is hereby created a Department of Community Development. Within the Department of Community Development there shall be a Division of Planning, Zoning and Subdivision Control, and a Division of Rent Review Administration 2-32.2 Director of Community Development. The head of the Department of Community Development shall be the Director of Community Development who shall be appointed by the Mayor with the advice and consent of the Council, for the term of the Mayor appointing him and until the appointment and qualification of a successor, and shall receive such compensation as shall be fixed from time to time by a general salary ordinance. The Director shall be the appointing authority for all technical personnel necessary to carry out the functions of the Department. 2-32.3 Responsibilities. The Department of Community Development shall have responsibility for: a. Preparing, coordinating and implementing, as appropriate, all Township plans related to community development, housing, capital programs, and such other areas as may be directed by the Mayor; b. Applying for and administering all grants from State, Federal, or other sources related to the above; c. Providing staff assistance to the Planning Board, Zoning Board of Adjustment, Rent Review Board, and such other boards as may be assigned by the Mayor; d. Administration and enforcement of the Zoning Ordinance through the subdivision of the Zoning Officer; e. Administration and enforcement of planning approvals and subdivision approvals, utilizing data compiled by the Department of Engineering, and the Department of Construction Code Enforcement and Inspections; f. Administer and enforce the Township Property Maintenance code, Ordinance 74-4, as amended; (See Chapter XV) g. Such other duties as may be directed by the Mayor. ARTICLE XV DEPARTMENT OF CONSTRUCTION CODE ENFORCEMENT AND INSPECTIONS 2-33 CONSTRUCTION CODE ENFORCEMENT AND INSPECTIONS. (amended to read) 2-33.1 Department Created. There is hereby created a Department of Construction Code Enforcement and Inspections. 2-33.2 Building Construction Official; Compensation. The head of the Department of Construction Code Enforcement and Inspections shall be the Building Construction Official, who shall be appointed by the mayor, with the advice and consent of the Township Council, for a four (4) year term, pursuant to the provisions of N.J.S.A. 52:27D-126. The Building Construction Official shall receive such compensation as shall be fixed by a general salary ordinance, and shall be the appointing authority for all technical personnel necessary to carry out the functions of the Department. 2-33.3 Subcode Officials; Compensation. Within the Department of Construction Code Enforcement and Inspections there shall be such subcode officials as are required under the Uniform State Construction Code Act, who shall receive such compensation as shall be fixed from time to time by a general salary ordinance, and who shall be appointed for a four (4) year term pursuant to N.J.S.A. 52:27D-126. 2-33.4 Duties of Department. The Department of Construction Code Enforcement and Inspections shall be charged with the following duties: a. Receive application for Occupancy and Building Permits; b. Review all drawings and plans for Building and Construction Applications; c. Administer and enforce the Township Building Ordinance and the New Jersey Uniform Construction Code; d. Inspect all on-site improvements installed in all building projects within the Township; e. Such other duties as may be directed by the Mayor. BE IT FURTHER ORDAINED by the Township Council of the Township of Cherry Hill, County of Camden, State of New Jersey that Ordinance 95-36 entitled "Revised General Ordinance, Township of Cherry Hill," Chapter 2, Article V (Organization) be amended as follows: 2-5 ADMINISTRATIVE ORGANIZATION. 2-5.1 Allocation of Functions, Powers and Duties. (amended to read) All of the administrative functions, powers and duties of the municipality other than those vested in the Office of the Clerk, shall be allocated among and within the following departments: a. Department of Administration; b. Department of Law; c. Department of Public Works; d. Department of Engineering; e. Department of Police; f. Department of Recreation; g. Department of Community Development; h. Department of Construction Code Enforcement and Inspections; i. Chief of Staff and the following boards, commissions, agencies and instrumentalities which permitted by law, and as may be required by N.J.S.A. 40:69A-43(a): j. Planning Board; k. Zoning Board of Adjustment; I. Free Public Library; m. Board of Recreation Commissioners; n. Municipal Court; o. Rent Review Board; and the following boards, commission agencies and instrumentalities which are permitted by law and which may be created, revised, appointed in an advisory capacity to the Township on an as needed basis: p. Animal Control Advisory Board; q. Advisory Board of Health; r. General Board of Assessments; s. Senior Citizens Advisory Board; t. Advisory Cultural Arts Board.
